...Recommendations

Direct the City Manager and City Attorney to clarify with the County of Santa Clara on whether Outdoor Theater Uses is allowed per the current health order, and

1. If allowed, confirm whether it is permissible under the City’s ordinances and return to City Council immediately with a resolution and any relevant ordinance changes that classifies Outdoor Theater Uses as a temporary permissible use under the San José Al Fresco program; or

2. If Outdoor Theater Uses are not authorized by either the State or County health orders, then prepare the policy changes to bring to Council once the use becomes allowable.
